The Law concerning Marriage, Divorce and Family

The Law concerning

Marriage, Divorce and Family

40. To honor father and mother (Ex. 20:12 “Honor your father and your mother, that your days may be long upon the land which the YAHWEH our El is giving you.) Honor thy father and thy mother is an obligation that endures as long as one’s parents are alive. They must always be respected and must be obeyed while under their direct authority in the home prior to a young person’s marriage (Gen 2:24, i.e., leave his father and his mother). This commandment begins the second table of the law. The first four reveal our duty to YAHVEH; the final six our proper relations with man. This command is one of the 10 commandments which inter broken down into three other commandments 60 – 62.

41. Not to smite a father or a mother (Ex. 21:15“And he who strikes his father or his mother shall surely be put to death.) The word strike come from the Hebrew word נכה  nâkâh   naw-kaw' A primitive root; to strike (lightly or severely, literally or figuratively): beat, cast forth, clap, give [wounds],  go forward,  kill, make [slaughter], murderer, punish, slaughter, slayer pr slaying, smiter, striking, be stricken, (give) stripes, or to wound. One who strike his father or mother is liable to death if he caused a bruise. This is in contrast to an ordinary assault, for which the perpetrator would pay damages, if any, regardless of whether he caused a bruise.

42. Not to curse a father or mother (Ex. 21:17“And he who curses his father or his mother shall surely be put to death.) (Concerning rebellious children. It is a capital crime, to be punished with death, for children if: To strike their parents so as either to draw blood or to make the place struck black and blue. Or, The undutiful behavior of children towards their parents is a very great provocation to YAHVEH our common Father; and, if men do not punish it, he will. Those are perfectly lost to all virtue, and abandoned to all wickedness, that have broken through the bonds of filial reverence and duty to such a degree as in word or action to abuse their own parents. What yoke will those bear that have shaken off this? Let children take heed of entertaining in their minds any such thought or passions towards their parents as savor of undutiful-ness and contempt; for the righteous EL searches the heart.)

43.   To reverently fear father and mother (Lev. 19:3 ‘Every one of you shall revere his mother and his father, and keep My Sabbaths: I am the YAHWEH our El.) (The fear here required is the same with the honor commanded by the fifth commandment. It includes inward reverence and esteem, outward expressions of respect, obedience to the lawful commands of parents, care and endeavor to please them and make them easy, and to avoid every thing that may offend and grieve them, and incur their displeasure. The Jewish doctors ask, "What is this fear that is owing to a father?’’ And they answer, "It is not to stand in his way nor to sit in his place, not to contradict what he says nor to carp at it, not to call him by his name, either living or dead, but ’My Father,’ or ’Sir;’

1. it is to provide for him if he be poor, and the like.’’

2. Children, when they grow up to be men, must not think themselves discharged from this duty: every man, though he be a wise man, and a great man, yet must reverence his parents, because they are his parents.

3. The mother is put first, which is not usual, to show that the duty is equally owing to both; if the mother survive the father, still she must be reverenced and obeyed.).

44. To be fruitful and multiply (Gen. 1:28 Then Elohim blessed them, and Elohim said to them, “Be fruitful and multiply; fill the earth and subdue it; have dominion over the fish of the sea, over the birds of the air, and over every living thing that moves on the earth.) We are call to bring forth, grow, increase produce fruit. Fruitful in these sense depict both spiritual and physical fruit. How does YAHWEH multiply? He multiply through us. When He created the flesh, Elohim breath into us the breath of life (Himself) and man became a living soul. Psalms 82:5 and John 10:35 both explain that we are god. However many of us will die like men. We are not called children of EL by mistake, please take it literary. The fruitfulness that YAHWEH is alluding to is the developing of the spirit of man, so that like Messiyah Yahushua we can become one with the Father, through the indwelling of the Holy Spirit, full maturity.

45. That a eunuch shall not marry a daughter of Yisrael (Deut. 23:2 “One of illegitimate birth shall not enter the assembly of YAHVEH; even to the tenth generation none of his descendants shall enter the assembly of YAHVEH.) This command teaches us that a eunuch is a person who has is tentacle crush. Organs have been severely damaged, so that he is impotent, may not marry. If, however, the disability came about through natural means, such as a birth defect or illness, this prohibition does not apply. The goal of every daughter of Yisrael is to provide mature sons for the Kingdom. If a man is unable to impregnate his wife, then she cannot fulfill her role as a mother in Yisrael.

46. That a mamzer an unsaved shall not marry the daughter of a (saved) Hebrew (Deut. 23:3 “An Ammonite or Moabite shall not enter the assembly of YAHVEH; even to the tenth generation none of his descendants shall enter the assembly of YAHVEH forever.) (This command teaches us that it is like saying that a Hebrew person should not marry any German for what the Nazi did to them during WWII. Contrary to the popular misconception, a mamzer is not someone born out of wedlock. Rather, it is someone born of a union between a man and woman whose union could never be valid by Torah, such as a union between brother and sister or other such forms of incest, or a married woman who bore another man’s child. A mamzer and all of his or her descendants may never marry into the nation).

47. That an Ammonite or Moabite shall never marry the daughter of an Yisraelite (Deut. 23:4 “because they did not meet you with bread and water on the road when you came out of Egypt, and because they hired against you Balaam the son of Beor from Pethor of Mesopotamia, to curse you.) (This command teaches us that this is an unequally yoke command, a messiyanic should never marry a Christian. The Ammonites and Moabite nations are descendant of Lot, whose be factor and savior was his uncle Abraham, but  instead of showing common hospitality to the Hebrew when they were trudging through the desert Ammon refused even to sell them bread or water, and Moab, who sold then food and water sinned by hiring Balaam to curse them. Therefore, the Torah banned them from joining the Hebrew people in union. This lack of gratitude was indicative of an ingrained selfishness and mean-spirited character that has no place in Yisrael).

48. Not to exclude a descendant of Esau from the community of Yisrael after three generations (Deut. 23:7 You shall not abhor an Edomite, for he is your brother. You shall not abhor an Egyptian, because you were an alien in his land. 8“The children of the third generation born to them may enter the assembly of YAHVEH.) (This command teaches us that Both the Edomite and the Egyptian are un redeemed people. There is a demonic spirit over them. Three generation should past before we can allow them to enter our mids.

49. Not to exclude an Egyptian from the community of Yisrael for three generations (Deut. 23:7 …. You shall not abhor an Egyptian, because you were an alien in his land. 8“The children of the third generation born to them may enter the assembly of YAHVEH.) This command teaches us that the children born to them may serve in the congregation after the third generation of living in Yisrael. Both Edom, the descendant of Esau, and Egypt, the slave master of Yisrael, had harmed the Hebrew people mightily, but we are enjoined not to treat them in kind. Edom is a kinsman, and Egypt had provided food and lodging when Jacob and his family had to go there. Nevertheless, if Edomites are Egyptians convert to Judaism, they must wait until the third generation, until the basemess of their original works its way out of their offspring, before they are allowed to marry into Yisrael

50. That there shall be no harlot (in Yisrael); (Deut. 23:18 There shall be no ritual harlot of the daughters of Yisrael, or a perverted one of the sons of Yisrael). This command teaches us, that a promiscuous woman who make themselves available constantly for sexual activity. According to this command it is directed at the court, instructing them not to permit such people to parade themselves in public to indicate their availability, and to prevent the establishment and maintenance of places where such activities will take place. There shall be no intercourse with a woman, who serves many gods or one who had many other relationship. One who jumps from one relationship to another will more or less do the same in the spiritual context. When Jacob took four wives, if it was a sin then the six sons other than that of Leah were sons of an harlot.

51. To take a wife by kiddushin, (Deut. 24:1 “When a man takes a wife and lay with her, and it happens that she finds no favor in his eyes because he has found some uncleanness in her, and he writes her a certificate of divorce, puts it in her hand, and sends her out of his house,) (This command teaches us the way a man may divorce his wife, is if he see any unclean in her, such as adultery )

52. That the newly married husband shall (be free) for one year to rejoice with his wife (Deut. 24: 5“When a man has taken a new wife, he shall not go out to war or be charged with any business; he shall be free at home one year, and bring happiness to his wife whom he has taken.) (This command teaches us that a man that takes a new wife is exempt from military service for one year. They he may enjoy his new wife).

53. That a bridegroom shall be exempt for a whole year from taking part in any public labor, such as military service, guarding the wall and similar duties (Deut. 24: 5“When a man has taken a new wife, he shall not go out to war or be charged with any business; he shall be free at home one year, and bring happiness to his wife whom he has taken.)(This command teaches us that a man that takes a new wife is exempt from military service for one year. This command teaches us that they may however serve in the rearguard who supply the frontline solders, but not in any activity that take him away form home for an extended period of time)

54. Not to withhold food, clothing or conjugal rights from a wife (Ex. 21:10 “If he takes another wife, he shall not diminish her food, her clothing, and her marriage rights. 11“And if he does not do these three for her, then she shall go out free, without paying money.) (These are the three responsibilities of a man to his woman, if the man does not perform these to her she have a right to leave him, without paying any penalty.  Notice it also said that IF, a man take a another wife).

55. That the woman suspected of adultery shall be dealt with as prescribed in the Torah (Num. 5:30 or when the spirit of jealousy comes upon a man, and he becomes jealous of his wife; then he shall stand the woman before YAHVEH, and the priest shall execute all this law upon her. 31‘Then the man shall be free from iniquity, but that woman shall bear her guilt)( This command teaches us that if she is guilty, she dies, but even if the water proves her innocent, she will have suffered public humiliation for the sin of secluding herself with the suspected adulterer in defiance of her husband’s misgiving).

56. That one who defames his wife's honor (by falsely accusing her of unchastity, must live with her all his lifetime (Deut. 22:19 “and they shall fine him one hundred shekels of silver and give them to the father of the young woman, because he has brought a bad name on a virgin of Yisrael. And she shall be his wife; he cannot divorce her all his days. (As the husband represent the priesthood and the woman represent the people. The Man is not supposed to falsely accuse any member of the flock falsely. If she violate any of the commandment she must be reprimand first to her face, if she does not change she must be reprimanded in the present of two, if that does not change she must betaken in front of the ruling body. If the husband or ministry falsely accuses her, she must continue to be in that flock all his life. One hundred shekels is about $70,000.00 in today’s currency).

57. That a man may not divorce his wife concerning whom he has published an evil report (about her unchastity before him) (Deut. 22: 19“and they shall fine him one hundred shekels of silver and give them to the father of the young woman, because he has brought a bad name on a virgin of Yisrael. And she shall be his wife; he cannot divorce her all his days.) (The story of Joseph and Mary, is a fulfillment of the command. Joseph been a righteous man seek to put her away privately, until he was spoken to by the Holy Spirit. Not only must he pay the father, he must also keep her as a wife all her life).

58. To divorce by a formal written document (Deut. 24:1 “When a man takes a wife and marries her, and it happens that she finds no favor in his eyes because he has found some uncleanness in her, and he writes her a certificate of divorce, puts it in her hand, and sends her out of his house, 2“when she has departed from his house, and goes and becomes another man’s wife,) The written document is Torah, in a matter of divorce the violation of the covenant must be shown to her so that she may know what law she as broken.

59. That one who divorced his wife shall not remarry her again, if after the divorce she had been married to another man (Deut. 24:3 “if the latter husband detests her and writes her a certificate of divorce, puts it in her hand, and sends her out of his house, or if the latter husband dies who took her as his wife, 4“then her former husband who divorced her must not take her back to be his wife after she has been defiled; for that is an abomination before YAHVEH, and you shall not bring sin on the land which the YAHWEH our El is giving you as an inheritance.) (This command teaches us that if we have tasted of the goodness of YAHWEH and leave Him for another master, He will not take us back. Married here is the sexual act between a man and a woman. It is not going in front of a priest and saying I do.)

60. That a widow whose husband died childless, must not be married to anyone but her deceased husband's brother (Deut. 25:5 “If brothers dwell together, and one of them dies and has no son, the widow of the dead man shall not be married to a stranger outside the family; her husband’s brother shall go in to her, take her as his wife, and perform the duty of a husband’s brother to her.) The building of the Kingdom is the first priority, if our brothers kingdom need to be develop, it is his brother responsibility to help him do so. This scripture says that the brother must go in to her, and have sex with her, this is performing the duty of a husband.

61. That the widow formally release the brother-in-law (if he refuses to marry her) (Deut. 25:7“But if the man does not want to take his brother’s wife, then let his brother’s wife go up to the gate to the elders, and say, ‘My husband’s brother refuses to raise up a name to his brother in Yisrael; he will not perform the duty of my husband’s brother.’ 8“Then the elders of his city shall call him and speak to him. But if he stands firm and says, ‘I do not want to take her,’ 9“then his brother’s wife shall come to him in the presence of the elders, remove his sandal from his foot, spit in his face, and answer and say, ‘So shall it be done to the man who will not build up his brother’s house.) This command teaches us that the whole purpose is to raise up a name for his brother. An heir was a very important thing in biblical days as it is to be today.  If an evangelist brings someone to Yahushua, I cannot say it is not me who brought him to salvation, I am still obligated to teach him how to observe Torah. The Evangelist will get his reward for initial salvation, and I will get my reward for teaching or for bringing him to maturity.
